We are updating the braintree payment agreement for our services outside the United States to reflect that PayPal is a payment and fraud service manager. Our Privacy Policy has been updated with effect from July 31, 2020, if you registered before March 23, 2020, or with immediate effect if you registered on or after March 23, 2020 to reflect our change as responsible for these activities. You do not need to act since the changes will automatically come into effect on December 1, 2020. If you refuse to change these agreements, you must close your account before the effective date(s) and these changes do not apply to you. Customer Data – The personal data that the customer provides to the reseller and reseller is transmitted to Braintree through the use of braintree`s payment services by the customer. “customer data” means the personal data that the customer (i) makes available to the distributor and PayPal transmitted through the merchant`s use of the payment processing services and (ii) may collect PayPal of the customer`s device and browser using the merchant`s payment processing services. Customer data, as used in this addition, does not include personal data of the reseller`s U.S. customers. The parties acknowledge and agree that PayPal has the right to use, reproduce and process customer data and information relating to payment transactions for the following limited purposes: 2.1.1. PayPal, your service provider is only a service provider with respect to customer data, including personal data of customers and other natural persons, households and entities, for the purposes set out in the agreement.
You agree to provide PayPal only the customer data necessary to PayPal to the provision of the payment services. The parties acknowledge and agree that PayPal has the right to use, reproduce and process customer and payment transaction data for the following limited purposes: the Merchant agrees to PayPal: to maintain, defend and hold harmless its parent company, related companies, senior officers, directors, representatives, employees and suppliers of and against legal actions, claims, liability, losses, penalties or other expenses (including attorneys` and defense fees) that they suffer or may incur as a result of (i) your breach of this Agreement or any other agreement you may enter into with PayPal or its suppliers with respect to your use of brain payment services; (ii) your use of brain payment services; (iii) your acts or omissions; and/or (iv) your violation of applicable laws, regulations or network rules. By accepting this CEA (through a “Click Through” or other agreement), you agree to the terms of this CEA and all documents added by reference. Customer Braintree also agrees that this CEA is a legally binding contract between customer Braintree and Wells Fargo. All rights not expressly granted herein are reserved to Wells Fargo. The transfer and processing of specific categories of data is not foreseen. If there is no processing activity for a period of twelve (12) months or more through your bank-sponsored merchant accounts, PayPal may close such bank-sponsored inactive merchant accounts and terminate the Gateway Services upon written notice. If required by applicable law, PayPal remaining funds will be sent to your country of residence.
If you wish to obtain escheated funds from the relevant state, please contact the unclaimed property manager of the relevant state. You remain responsible for any outstanding obligations arising from this agreement regarding your bank-sponsored trading accounts prior to closing. 9. assignment; Amendments.
