The Indiana Association of Nurse Anesthetists, a public professional organization, provided additional information on nurse anesthetist activity in Indiana. [4] Under Indiana law, a nurse cannot prescribe legendary drugs2 without having a practice agreement with a licensed physician. Dr. Collip and Barger joined the CPA in 2006. According to the CPA, Barger practiced under the direction and supervision of Dr. Collip; Barger paid Dr. Collip for his surveillance. Dr. Collip admitted that he knew that Barger`s patients could be put at risk if he did not do what he was asked to do under the CPA. He knew that he had an obligation to ensure that Barger adequately supplied his patients, including prescription care.

Although Dr. Collip was not interested in ownership of a clinic or job, his name appeared with Bargers at the top of the clinic`s pre-printed prescription forms and on the clinic`s stationery. [3] The Indiana General Assembly has adopted a complex and detailed legal system allowing nurses to provide medical services. In the language of status, we conclude that one of the objectives of this legislation was to improve public access to affordable health care. Parliament also wanted to ensure public safety by requiring that nurses be supervised by a licensed physician when prescribing legendary drugs. We are legally in such a way that physicians who assume this responsibility owe the nurse`s patients the obligation to fulfill their contractual obligations with due diligence. We`re on remand. [6] In addition to the CPA with Barger, Dr. Collip had practice agreements cooperating with eleven to twelve other nurses. He also worked ninety hours a week as a family doctor. [23] The three factors Webb v. Jarvis strongly supports the introduction of an obligation.

Therefore, we are legally in a position to ensure that a physician who takes a CPA with a nurse has an appropriate duty of care to the nurse`s patients when fulfilling his or her obligations under the ACC. A cooperation agreement between the doctor and the PA is required. The agreement must cover all the tasks delegated by the doctor and indicate the protocol that the AP must follow when prescribing a drug, among other things. I didn`t do it. Code No. 25-27.5-5-2 An advanced practice nurse who prescribes controlled substances also requires registration for controlled substances or CSR and registration from the Federal Drug Enforcement Administration. An advanced non-state practitioner must take continuing education courses when his or her qualified pharmacology training has been completed for five years or more. The accrediting body may accept continuing education courses at any time in the past two years.

The applicant must justify a total of 30 hours of training, of which at least eight are pharmacology-based. The advanced non-state practitioner must also demonstrate recent prescription experiments. Indiana is one of the few states where nurses do not need to be certified nationally. However, most PNs practising in the state obtain national certification. Medicare and other health insurance companies generally require national certification and reimbursement, which means that NPPs who practice without certification may not be eligible for payment by these institutions.
